It took
many years of effort, but Ohio has enacted a new law
which gives the right-of-assignment to collection
agencies. The Senate Bill 180, signed by Ohio Governor
George Voinovich, will permit collection agencies to
bring civil actions in their own name for collection
of assigned debts. This measure took effect on
September 15, 1996.
Under this new law, two or more creditors of a debtor
or co-debtor may join their respective claims together
in order to begin litigation. The law permits an Ohio
collection agency to take an assignment in its name.
